Copyright Infringement Notification

CDD Graffix, LLC respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement committed using our site if those claims are reported to our designated Copyright Agent.

How to File a DMCA Takedown Notice

If you believe that your work has been copied in a way that constitutes copyright infringement, please submit a written notification containing the following information (pursuant to 17 U.S.C. ยง 512(c)(3)):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address at which you may be contacted;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note: Failure to comply with all the requirements above may result in your notice being invalid under the DMCA.

Repeat Infringer Policy

CDD Graffix, LLC reserves the right to disable and/or terminate the accounts of users who are repeat infringers. This policy is enforced in accordance with the DMCA and applicable intellectual property laws.

Counter Notification

If you believe that your content was mistakenly removed or disabled pursuant to a DMCA takedown notice, you may submit a counter-notification to our Copyright Agent. Please include:

  • Your signature (physical or electronic);
  • Identification of the content that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled;
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification;
  • Your name, address, telephone number, and email address; and
  • A statement that you consent to the jurisdiction of the federal district court in your judicial district and that you will accept service of process from the person who provided the original DMCA notice or their agent.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may reinstate the content in accordance with DMCA procedures.
